These Terms and Conditions of Use (the "Terms") govern the Bangur Cement Nirman Mitra 2.0 Mobile Application (hereinafter referred to as "the Application" or "we") and the associated Loyalty Program by invite for Masons and Contractors (the "Program"). The program is being run by Shree Cement Limited (“SCL”) in collaboration with a third party (“Service Provider”).
By installing, accessing, or using the Application, the Member acknowledges that they have read, understood, and agreed to be bound by these Terms. If the Member does not agree to these Terms, they should refrain from using the Application.
By accessing or using the Application or participating in the Program, Contractor/Mason ("Member") agree to be bound by these Terms.
1. Membership and Eligibility Criteria
Membership in the Program is by invitation only, and the Member must fulfill the eligibility criteria specified for enrollment. The eligibility criteria will be solely determined by the Company.
3. Membership Termination
Points cannot be accumulated or redeemed if the Membership is withdrawn, canceled, or subject to cancellation due to a violation of the Terms and Conditions by the Members or Facilitators.
4. Points Non-Transferable
The points issued to Members are non-transferable and cannot be shared with other Members in any form.
5. Ownership and Governance
The Nirman Mitra App/Website is owned and developed by Shree Cement Limited, and the Scheme's benefits, validity, and points' expiration are governed by SCL.
6. License and Use of the Application
a. Subject to compliance with these Terms, the Application grants the Member a non-exclusive, non-transferable, limited license to use the Application for personal, non-commercial purposes.
b. The Member agrees not to:
i) Modify, adapt, translate, reverse engineer, decompile, disassemble, or attempt to derive the source code of the Application.
ii) Use the Application in any manner that violates applicable laws or regulations.
iii) Transmit any content that is unlawful, offensive, or violates the rights of others.
iv) Access the Application using any unauthorized means or interfere with its proper functioning.
7. Privacy and Data Collection
The Member's use of the Application is subject to our Privacy Policy, which outlines how personal data is collected, stored, and used. By using the Application, the Member consents to the data practices described in the Privacy Policy.
8. Intellectual Property Rights
The Application and its content, including but not limited to text, graphics, logos, and images, are protected by intellectual property rights. The Member agrees not to reproduce, distribute, or create derivative works from the Application's content without the prior written consent of the Application.
9. Termination
The Application reserves the right to terminate or suspend the Member's access to the Application at its discretion, without notice, for any violation of these Terms or for any other reason.
10. Disclaimers
The Application is provided on an "as is" and "as available" basis. The Application makes no warranties or representations regarding the accuracy, reliability, or availability of the Application.
11. Limitation of Liability
The Application shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with the use of the Application.
12. Queries and Information Updates
Members can contact their respective Sales Point of Contact (SPOC) for Program-related queries or account balance inquiries.
13. Consent for Data Sharing
Members must obtain consent from their Customers/IHB before sharing their personal information within this Program. By registering and submitting Personal Information, Contractors grant unconditional authorization to SCL to use such information in accordance with Company guidelines. Usage of the App/Website is subject to guidelines set by SCL, which may change without prior notice.
14. Liability
SCL is not liable for any physical injury, mental trauma, monetary loss, or damages arising from the Program.
15. Accurate Information
Members must provide accurate Personal Information. Misrepresentation will result in permanent disqualification from the Program. Members must promptly inform SCL of any changes to their contact information, or any discrepancies discovered by SCL may result in points forfeiture and account closure.
16. Cessation of Membership
If a Member's status under Nirman Mitra ceases, they will no longer be able to use the App/Website, and SCL will not be liable to continue permitting access.
17. Access
SCL is not responsible for lost or stolen access details.
18. Governing Law
These Terms are governed by and construed in accordance with the laws of India.
19. Process to delete account
To delete account user has to click on “Delete Account” option in the left menu bar in the app or contact vide email id: nirmanmitra@shreecement.com
These Terms and Conditions of Use are effective from 2024-09-16. By using the Bangur Cement Nirman Mitra 2.0 mobile application and participating in the Program, Members acknowledge that they have read, understood, and agreed to these Terms and Conditions.
